Terms of Use

This Terms of Use Agreement ("Agreement") is entered into between users ("User") who will use the mobile application or platform Iman App ("Application") and Peace Apps Limited ("Company"), located at AA House, 336 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX, to regulate the terms and conditions of using the application and services.

This Agreement takes effect as soon as the User accesses the application, creates an account, and/or uses the services.

Iman App is a platform designed to provide users with easy access to services related to religious matters. Through the application, users can communicate with imams and access certain religious content. The application is designed to respond to individual spiritual needs within the conditions specified in this Agreement and does not aim to provide services on behalf of any religious authority.

The Application is designed to offer certain services to the User, and the scope and terms of use of these services are detailed below. The User, by using the application, declares and undertakes that they have read, understood, and accepted all terms of this Agreement. If the User does not accept these terms, they must immediately stop using the application.

Definitions

• Application: Refers to the mobile and/or web-based platform called Iman App.
• User: Refers to the real person who accesses, registers, or benefits from the services of the application.
• Imam: Refers to individuals knowledgeable in religious matters who provide specific services and facilitate religious discussions through the application.
• Services: Refers to religious Q&A, shared religious materials, and other content offered through the application.
• Account: Refers to the personal profile created by the User to benefit from the services through the application.
• Content: Refers to all written, visual, audio, and digital materials available within the application.
• Third Party: Refers to persons or organizations that provide services through the application but are not directly affiliated with the Company.
• Coin System: Refers to digital points that Users can earn or purchase for specific transactions and/or payments.

• Content of the service

  • Service Definition: The User acknowledges that the services offered are limited to the scope specified in this Agreement and that any services not explicitly stated here or derived through broad interpretation are excluded.
  • Who is an Imam: The imams providing services in the application are not necessarily official mosque imams. Instead, they are individuals with religious knowledge who offer religious discussions and Q&A services to Users.
  • Services Provided by Imams: The services provided by imams do not fall under official religious services provided by the Presidency of Religious Affairs (Diyanet İşleri Başkanlığı) or any state institution. These services are based on mutual support and are not intended to direct users toward any specific religious practices. They do not include the issuance of official fatwas or similar religious authority functions and should be used for consultation purposes only.
  • Not a Religious Organization: The Company and the Application are not a religious organization and operate with commercial intent. The Company acts in compliance with applicable legal regulations. The Application provides a platform for users to communicate with imams, but it does not promote, endorse, or advocate any specific religious belief.
  • No Guaranteed Results: The services provided are entirely spiritual and do not guarantee any specific results. The User acknowledges that the opinions of imams do not provide any guarantees and are based entirely on individual belief.
  • Service Modifications: The Company may expand, modify, or completely remove certain services at its sole discretion. Users accept that the terms of service may change without prior notice.

• Terms of service use

  • User Eligibility: To use the services through the website or application, individuals must enter the required information and meet the eligibility conditions stated in this Agreement. Persons under 18 years of age, legally incapacitated, or lacking legal competence can only perform transactions through their legal guardians or representatives. Any transactions made contrary to these conditions shall be considered invalid.
  • Purpose of Use: The application and services are for personal or religious purposes only. Users may not use the application for commercial purposes, illegal activities, or in any way contrary to its intended purpose. They must not share misleading or false information or engage in any actions that interfere with the functionality of the Application.
  • Security and Personal Account Responsibility: The User is personally responsible for securing their account and agrees not to share it with third parties. Users must not attempt to bypass the Application's security measures. If suspicious or unauthorized access is detected, Users must immediately contact support.
  • User-Generated Content: Users acknowledge that any content (prayer requests, posts, comments) shared in community areas or within the Application may be visible to other users. It is prohibited to share content that is offensive, illegal, harmful, misleading, harassing, threatening, or commercial in nature.
  • Content Moderation: The Company is not responsible for user-generated content. However, it reserves the right to remove any content deemed inappropriate.
  • Respect for Third-Party Rights: Users must not use the Application in a way that violates the privacy, copyrights, trademarks, or other intellectual property rights of third parties. Any legal liability arising from violations rests solely on the user.
  • Liability and Compensation: Users bear full responsibility for any damages caused by violating this Agreement or legal regulations. If the Company incurs legal or financial liabilities due to such actions, the User agrees to compensate for these damages without requiring further notice.
  • User-Imam Relationship: The Company is not responsible for the accuracy, transparency, or content provided by imams. Imams operate independently, and the Company does not pre-approve or monitor their content.
  • Ethical Conduct with Imams: Users must communicate respectfully with imams and must not make personal or commercial requests. Responses from imams do not constitute official fatwas but are based on religious knowledge.
  • AI-Generated Content: The Company may provide AI-assisted services. Users accept that AI-generated responses are based on provided inputs, and the Company is not liable for AI-generated content.

• Company's rights and obligations

  • The Company is responsible for ensuring the necessary technical infrastructure and security measures to provide the best possible user experience.
  • The Company commits to making reasonable efforts to ensure the continuous operation of the application and to improve the user experience. However, it does not accept liability for service interruptions caused by force majeure or technical failures.
  • The Company may implement monitoring and control mechanisms to ensure that Users conduct their in-app activities in compliance with legal regulations.
  • The Company does not intervene in disputes between Users but reserves the right to remove content that violates community guidelines and suspend user accounts when necessary.
  • The User accepts that the Company may display advertisements, promotions, and sponsorship content within the application and associated platforms. The Company may display text, images, videos, audio content, or other interactive formats of advertisements. Ads may be personalized based on User's in-app activities.
  • The User accepts that the Company may use their personal data in an anonymized manner or process it within the scope of data protection regulations to display interest-based advertisements.
  • The application may contain advertisements and promotional content belonging to third parties. The Company is not responsible for the accuracy or content of these ads and does not accept liability for any disputes that may arise between the User and advertisers.
  • Users who wish to avoid certain advertisements may opt for a paid version or premium services. The Company reserves the right to offer an ad-free experience as part of a paid membership.
  • The Company may conduct promotional campaigns in collaboration with certain brands, organizations, or third-party business partners. Such campaigns aim to enhance user experience and ensure the sustainability of the application.
  • If permitted in the settings, the User accepts that the Company may send in-app notifications for marketing and informational purposes. Users who do not wish to receive these notifications may change the relevant settings or contact the Company to submit a request.
  • The Company reserves the right to change advertising policies and ad placements within the application. By continuing to use the application, the User is deemed to have accepted the updated advertising policies.

• Fees and payments

  • In-App Purchases and Modification Rights: The Company may enable Users to purchase access to specific services through the Coin System or alternative payment methods. The Company reserves the right to modify the in-app purchasing system, update prices, introduce new pricing models, convert free features into paid features, or offer previously paid services for free. Users may not claim any rights due to these changes.
  • Payment Policies: Payments within the application are processed through third-party payment providers (Apple App Store, Google Play, etc.). After completing a payment, Users may not have the right to a refund or cancellation. Users accept that they are subject to the terms and conditions of the payment providers.
  • Changes to Pricing Policies: Any changes in fees and payment conditions will become effective as of the date of the change. By continuing to use the services, Users are deemed to have accepted the modified terms.
  • Discounts and Promotions: The Company may offer discounts or promotions to Users at specific times. Such campaigns will be valid for a limited period and may be canceled or modified by the Company.
  • Accuracy of Payment Information: The User is responsible for providing complete and accurate payment details. The Company is not responsible for any disruptions arising from incorrect or incomplete payment information.
  • Subscription and Renewal: If the User subscribes to the application, their subscription may be automatically renewed at the end of the designated period, unless canceled. Users are responsible for following the subscription cancellation guidelines of the relevant platform (Apple App Store, Google Play, etc.).
  • Unauthorized Transactions and Fraud: The User is responsible for avoiding unauthorized transactions and fraudulent activities within the application. If the Company detects suspicious or fraudulent transactions, it reserves the right to suspend or terminate the associated accounts.

• Intellectual property

  • Content and Copyrights: All audio, visual, written materials, documents, and other content within the application are protected by intellectual and industrial property rights and belong to the Company. Users may not reproduce, copy, modify, sell, or use these contents for commercial purposes without permission.
  • Software and Technology Rights: The Company owns all software, code structures, algorithms, and technological components used within the application. Users may not engage in reverse engineering, code decryption, or re-compilation processes.
  • Prohibition of Unauthorized Use: Users may not copy, modify, or republish the application's content or functionality for personal or commercial gain.
  • Trademarks and Logos: All logos, trademarks, and service names within the application belong to the Company or relevant rights holders. Users may not use these trademarks, logos, or corporate identity elements without permission.
  • Usage Rights: The Company may use User-generated content for application development and promotional purposes.
  • Intellectual Property Infringement: If a User violates intellectual property rights, they bear full legal responsibility. The Company reserves the right to suspend or terminate accounts that infringe intellectual property rights.
  • Artificial Intelligence and Anonymous Data: The User accepts that anonymized data within the application may be used for artificial intelligence development, training, and analytical purposes. The Company retains full ownership of any models, outputs, and intellectual property derived from such data. Users cannot claim rights, compensation, or any financial interest over this data.

• Privacy and data usage

  • All details regarding privacy and data usage are outlined in the Privacy Policy, Cookie Policy, Information Notice, and Explicit Consent Form. The User declares that they have read, understood, and accepted these documents published by the Company.
  • The Company will protect and process the User's personal data and in-app usage information in compliance with applicable KVKK (Turkish Personal Data Protection Law) and GDPR regulations.
  • The Company may request explicit consent from the User when necessary and may require additional approval for certain services. If the User does not provide the requested consent, they acknowledge that they may not be able to benefit from certain services.
  • The Company reserves the right to modify the above-mentioned documents and will enforce updated policies upon notifying the User.
  • By continuing to use the application, the User is deemed to have accepted the updated Privacy Policy and Cookie Policy.

• Disclaimer of liability and warranty

  • Services Provided "As Is": The Application and services are offered "as is" and "as available." The Company does not guarantee uninterrupted, error-free, or purpose-specific operation of the Application.
  • No Guaranteed Results: The Company does not guarantee that the services provided to the User will yield specific results or fully meet the User's expectations. The Application is for informational purposes only, and User experiences may vary based on personal beliefs.
  • Third-Party Content: Some content and services within the Application may be provided by third-party providers or imams. The Company does not guarantee the accuracy, completeness, or timeliness of third-party content and is not liable for any damages resulting from it.
  • Service Interruptions and Technical Issues: The Company makes reasonable efforts to ensure the Application operates continuously and without errors, but it cannot be held responsible for technical failures, maintenance work, system malfunctions, or force majeure events that may cause service disruptions.
  • Data Loss and Security: The Company is not responsible for any loss, unauthorized access, or security breaches related to User account information, messages, or other personal data. The User is responsible for ensuring their account security.
  • Legal and Financial Disclaimer: The User agrees to use the Application in compliance with laws and ethical standards. The Company is not responsible for any direct, indirect, incidental, special, or punitive damages arising from the User's misuse or illegal use of the Application. Apart from these exclusions, the Company's liability to the User is limited to the total amount of payments made by the User in the last six months.
  • Force Majeure: The Company is not responsible for service disruptions caused by natural disasters, war, riots, strikes, infrastructure failures, cyberattacks, legal regulations, or other unforeseen events.

• Termination of the agreement

  • The Company reserves the right to terminate this Agreement and restrict or revoke the User's access to the Application at its sole discretion and without providing justification. In such cases, the User cannot claim any rights or compensation.
  • The User may terminate this Agreement by permanently deleting their account. However, all transactions and obligations carried out before the termination date remain valid.
  • The User's obligations related to paid services remain in effect until the termination date. If the User does not cancel paid services before termination, automatic renewals and payments will continue, and the Company cannot be held responsible for this.
  • The Company reserves the right to take legal action against the User for any direct or indirect damages caused by violations of this Agreement. The User cannot claim any rights against the Company and is liable for compensating any damages incurred by the Company.

• Applicable law and dispute resolution

  • This Agreement and any disputes, interpretations, and applications arising from it shall be governed by the laws of the Republic of Turkey.
  • Any disputes arising from this Agreement shall be resolved in the Istanbul Central (Çağlayan) Courts and Enforcement Offices.
  • The User accepts that the Company's electronic records, system logs, commercial books, and emails shall constitute valid, binding, and conclusive evidence, and that this provision qualifies as an evidence agreement under the relevant provisions of the Code of Civil Procedure.

Cookie Policy

This Cookie Policy applies to the Iman App mobile application, managed by Peace Apps Limited. This policy explains how cookies and similar tracking technologies are used, what types of cookies we process, and how users can manage their cookie preferences.

By continuing to use the mobile application, you are deemed to have accepted this Cookie Policy. If you wish to restrict the use of cookies, you can modify your device or application settings. However, disabling certain cookies may prevent some functions of the application from working properly.

How Can You Control Cookies?

In mobile applications, cookies cannot be manually managed like in web browsers. However, in-app tracking technologies and advertising identifiers can be controlled using the following methods:

Managing Cookie and Tracking Settings on Android Devices:

• Disabling App Tracking and Personalized Ads
  • Open the Settings app.
  • Navigate to Google or Privacy settings.
  • Tap on Ads.
  • Enable the option "Opt out of Ads Personalization".
  • Tap "Reset Advertising ID" to change your current tracking ID.
• Clearing App Data to Reset Cookies
  Since most mobile applications store cookies in internal databases, you can reset them by clearing the app data:
  • Go to Settings > Apps > Iman App.
  • Tap Storage & Cache.
  • Use the "Clear Cache" or "Clear Data" option to reset cookies and tracking data.

Managing Cookie and Tracking Settings on iPhone and iPad (iOS):

• Disabling App Tracking and Advertising Identifiers (For iOS 14.5 and Later)
  • Open the Settings app.
  • Go to Privacy & Security > Tracking.
  • Turn off "Allow Apps to Request to Track" (When disabled, apps cannot track you).
  • To remove tracking permission for specific apps, select the app from the list and tap "Deny Permission".
• Disabling Apple Ads
  • Go to Settings > Privacy & Security > Apple Ads.
  • Enable the option "Limit Ad Tracking".
• Clearing App Data and Cache (Resetting Cookies)
  iOS does not provide a direct cookie management option, but you can reset the app's stored data by following these steps:
  • Go to Settings > General > iPhone Storage.
  • Find and tap Iman App.
  • Select "Delete App" and then reinstall it (This process resets all cookies and tracking data).
